Regulation of the Storage and Handling of Dangerous Goods
The storage and handling of dangerous goods and combustible liquids in Queensland is regulated by a number of Acts, namely:
- Dangerous Goods Safety Management Act (DGSM Act)
- Gas (Residual Provision) Act
- Explosives Act
- Health Act
- Radiation Safety Act
These Acts apply to different classes of dangerous goods and are administered by different agencies.
The DGSM Act provides an over-arching framework of obligations and requirements that facilitates a co-ordinated approach to the regulation of hazardous materials in Queensland.
Under the DGSM Act, the Department of Emergency Services has primary responsibility for administration. Enforcement of the Act is delegated, however, with specified classes of dangerous goods regulated by those Government agencies that have a specific interest in them. This arrangement is made possible by letters of delegation and associated Memoranda of Understanding.
